USER TERMS AND CONDITIONS

THIS USER TERMS AND CONDITIONS AGREEMENT (“Agreement”) is made by and between EVENT AND LIFESTYLE CITY GUIDE INC (Mynila) a company registered in the Philippines, whose registered office is at Level 26-A Rufino Pacific Tower, 6784 Ayala Avenue corner V.A. Rufino Street, 1226, Makati City hereinafter referred to as “Mynila”. -and-

A service user of Mynila.com heinafter referred to as "you," "online members," "registered members," “Service User,” “Ticket Customer(s)”.

BY CLICKING THE “ SIGN UP” BUTTON, YOU REPRESENT THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT, THE TERMS AND CONDITIONS AND THE PRIVACY POLICY. THESE TERMS REPRESENT A BINDING CONTRACT BETWEEN EVENT AND LIFESTYLE CITY GUIDE INC (MYNILA) AND YOU, THE REGISTERED MEMBER.

TERMS AND CONDITIONS

1. Rights, duties and responsibilities of the Service User

1.1 Mynila reserves the right to allow only service users who are registered members to order event admission tickets on the website.

1.2 In registering as an online member, the service user must provide the most up to date and correct personal information.

1.3 The service user agrees to change and/or to update personal information, specified in 1.2 to ensure that they are correct and up to date.

1.4 The service user agrees to take full responsibility for, but not limited to, the protection and quality of the ticket from theft, losses and any damages to the ticket itself.

1.5 In order to access the Service the Service User may be required to use a unique password ('Password'). The Service User may only disclose its Password to its duly authorised officers, agents or other representatives. The User is responsible for the security and proper use of its password and shall take all necessary steps to ensure that the password is kept confidential, used properly and not disclosed to unauthorised persons.

1.6 Mynila at its sole discretion reserves the right to:

    (i) refuse to accept a Service User's registration; or

    (ii) limit a Service User's access to the whole or any part of the Service.

1.7 The Service User acknowledges that despite Mynila taking reasonable precautions it is still possible that PDPs (potentially destructive contaminating or harmful programs or components, such as, but not limited to, worms, trojan horses and viruses ) may be transmitted from the Server or a server belonging to any third party to the User's Equipment. The User therefore accepts that is shall have full responsibility for protecting the User's Equipment from PDPs and Mynila shall have no responsibility for ensuring that content downloaded from the Website is free of PDPs.

1.8. Mynila shall be entitled to vary the technical specification of the Service and the Website from time to time. Mynila may, for this purpose, suspend access to the Website or close it indefinitely. Any of the material on the Website may be out of date at any given time and we are under no obligation to update our material.

2. LIMITATION OF LIABILITY

2.1 CONTENT

Although Mynila regularly conducts review(s) on the contents and consistency of the content on the website, Mynila cannot provide assurance that those contents shall always be correct, complete or up to date. The company, therefore, will not take any responsibility, directly or indirectly, for any mistake(s), delay of information availability and/or interruption of any equipment connection(s), whether or not someone has already notified and/or made a recommendation to the company that there was a chance for such a problem to occur.

2.2 RESPONSIBILITY OVER THE EVENTS AND SERVICES

The service user acknowledges that Mynila is only a digital ticket distributor for 3rd party event organisers and service user(s). Mynila, therefore, is not responsible for any damage, directly or indirectly, caused to any service user.

2.3 SERVICE SYSTEM

The service user acknowledges and agrees that the company cannot make an assurance that the access or the use of website, in whole or in part, cannot be made successfully, quickly, free of interference or mistakes all the time. The service user agrees that the company cannot assure that personal information provided by the service user, content, materials, products (including software) or services included on or otherwise made available to you through this site; their servers; or electronic communications sent from the company are free of viruses and/or other harmful components. The company will not be liable for any damages of any kind arising from the use of this site or from any information, content, materials, products (including software) or services included on or otherwise made available to you through this site and/or provided by the service user, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing. If such damages occur, the service user acknowledges and agrees that the company is not responsible for any damages caused to any electronic devices and/or the service user.

3. REFUNDS

It is the responsibility of the Event Organiser to make clear its refund policy to service users and to issue refunds to ticket customer. If a ticket customer desires to request a refund, the customer must request the refund from the Event Organiser. All communications or disputes regarding refunds are between the Event Organiser and the ticket customer and Mynila will not be responsible or liable in any way for refunds, errors in issuing refunds, or lack of refunds in connection with the Services.

(i) Individual refunds In the case of individual refunds requested by the service users, Mynila booking fee’s are non refundable and it is up to the discretion of the Event Organiser if they wish to refund the ticket in full.

(ii) Cancelled events If an event is cancelled a refund shall be issued to all ticket customers. In this case tickets shall be refunded in full, including Mynila booking fees. Mynila will invoice the Event Organiser for all applicable fees and issue these refunds in a timely manner

All communications and disputes regarding chargebacks and refunds are between the Event Organiser and ticket customer and Mynila will not be responsible or liable in any way for chargebacks in connection with a service users use of the Services. If you are a service users and you wish to request a refund in connection with an event listed on the services, you should contact the applicable Event Organiser directly.

3.1 TICKET DELIVERY AND COLLECTION

The Majority of Mynila tickets are digital tickets. When you purchase a digital ticket from Mynila, it will become available to download from “My Tickets” section on your user profile. An email containing the ticket link is also set, but we cannot guarantee that this will be received. You will not be entitled to a refund on the  basis that your ticket has nor been received by email.

For some orders we may email notifying you tickets will be sent by post or arrange for you to collect tickets from the venue or ticketing partners. In these cases you will be notified by email (using the details provided at the time of ordering). Please note our preferred method of contact for customers booking online is by email, so take care to provide a valid email address.

3.2 DAMAGED TICKETS, THEFT AND/OR LOSSES

The service user hereby agrees and acknowledges that Mynila will not be responsible and/or liable in any way for damages of any kind arising from damaged tickets, ticket theft and/or losses.

3.3 TICKET RE-SALE AND TRANSFERS

Mynila tickets are prohibited for resale and non transferable under any circumstance.

4. LINKS TO OTHER WEBSITES

Certain links, including hypertext links, in the Website will take the service users outside of mynila.com. Links are provided for the service users convenience and inclusion of any link does not imply endorsement or approval by Mynila of the linked site, its operator or its content. Mynila is not responsible for the content of any website outside the Website.

5. RIGHTS OF THE COMPANY

The company is entitled to correct, change or cancel any Terms and Conditions and/or Agreements without having to inform the service user in advance.

6.GOVERNING LAWS

This Agreement shall be governed and construed in accordance with Philippines Law and parties hereby submit themselves to the exclusive jurisdiction of the Philippines Courts in respect of any claim (including non-contractual disputes or claims).

Note: The company reserves the right to ensure that this website in maintained in good condition and within the scope of good ethical standard. Thus Mynila has the right to change the terms and conditions with no prior notice and/or acknowledgement of the user. We recommend you check and review the terms and conditions regularly.
